Terms & Conditions

These Terms and Conditions govern all bookings with Secret Garden Villa (“the Company”). Any booking made or order placed by you, whether through the Company’s website or otherwise shall be deemed an offer by you to rent the relevant accommodation subject to these terms and conditions. All bookings through our Company and all matters arising from them are subject to Cypriot law and to the exclusive jurisdiction of the courts of Cyprus. The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. Booking services with the company are currently only available to persons who are at least 18 years old. By submitting a booking, you warrant and confirm to us that you have read these Terms and Conditions and agree to comply with them.

Liability:

In consideration of the fact that the Company acts only as a booking agent, the Company accepts no liability whatsoever for any aspect of the arrangements and, in particular, accepts no liability for any loss, personal injury/illness or death, however incurred. Although the Company uses all reasonable endeavours to ensure the accuracy of all information provided and quality and facilities of the villas, we cannot accept any liability whatsoever for any problems that occur while guests occupy the villa of their choice. All information has been provided in good faith and no liability is accepted whatsoever by the Company for any misrepresentation of villa material or accommodation.

Booking and Payment:

A deposit payment of 25% of the total rental fee as well as the booking form are required in order to confirm a booking. If the reservation is made within 8 weeks of the date of arrival, then the full balance shall be payable. Otherwise, the balance of the rental sum shall be due for payment 8 weeks prior to the commencement of the rental period, whether this is requested by us or not. If this is not paid within 7 days of it being due, then we shall reserve the right to cancel the villa booking without a refund. In the event that the Company is unable to obtain final confirmation of the availability of the villa requested, then a full refund of the amount paid shall be given. The Company does not accept any responsibility for any cash sent by post. Payment can be made by cheque or bank transfer to our account. Booking confirmation together with a map or instructions for getting to the villa will be sent to you by e-mail or upon request, by post.

A returnable security deposit of £250 will be required, and will be payable upon arrival to cover any loss, breakages or damage occasioned by the use of the property by the parties to this agreement. The cost of any damage or breakages, except minor ones, shall be the tenant's responsibility and shall be payable to the owner upon demand. The security deposit shall be refunded after the property has been vacated following an inspection of the property upon your departure.

Arrival and Departure:

Arrival at the villa (unless otherwise advised to you in writing) should be after 3 pm local time. The property must be vacated by 11 am on the day of departure unless otherwise agreed with the owner. Vacating after 11 am may incur charges equivalent to the cost of one day's accommodation.

Cancellation by you:

In the event that you cancel your confirmed booking, the following cancellation charges shall apply:
Period before departure:                                Cancellation charge:

Cancellation by the villa owner:

If it is deemed necessary, the Company shall reserve the right to withdraw or cancel the villa booking. In this unlikely event, you will be offered the choice of renting another villa through our Company (subject to availability) with the price difference payable/refundable, as appropriate, or of receiving a full receive of all monies paid to the villa owner. No compensation shall be payable by the Company.

Force Majeure:

The owners of the property or their agents will not be liable for loss or delay caused by any of the following: strikes, riots, political unrest, hostilities, war or the threat of war, terrorist activity, industrial disputes, fire, flood, technical or weather problems involving transportation, aircraft grounding, closure of airports or ports, weather or any other event (s) beyond the owner's control.

Behaviour:

It is your responsibility to ensure that you and the members of your party do not act in a way which causes offence or danger to others or which risks damaging property belonging to others. Under such circumstances, the villa owner/s and the Company shall have the right to terminate any arrangements made on your behalf with immediate effect, in which case the Company’s responsibility to you shall cease forthwith and there will be no refunds, payments of compensation or reimbursement of any costs or expenses that you may incur as a result. Furthermore, you shall be liable to reimburse the Company for any expenses whatsoever it incurs as a result of such behaviour.

Breakages and Cleanliness:

Our accommodation is made available for letting on the understanding that the property shall be left clean and tidy at the time of checking out. Tenants shall be responsible for paying for any damage or breakages, which they should declare to the owner prior to their departure during an inspection of the property by the owner and any such costs incurred shall be deducted from the damage deposit by the owner. However, payment for any minor breakages, ie. cups and other crockery items, etc. shall be requested at the owner’s discretion. Tenants shall not be permitted to use any property intended solely for indoor use outside.

Air-Conditioning/Heating:

Whether the cost of any air-conditioning/heating is included in the villa price or stated as a supplement, it shall only be used while you are actually in the property, with all windows and doors closed. Under no circumstances must the units be left on continuously while the property is unoccupied. Where it is stated that an extra payment should be made for air-conditioning/heating, this is payable in full and is not negotiable.

Building work:

Any building work which may commence in the local area is beyond our control and we cannot be held responsible for any resulting disturbance. However, if we become aware of any building work which may reasonably be considered as adversely affecting enjoyment of the property, we shall notify you as soon as possible and wherever possible, we shall offer you the opportunity to transfer to an alternative property at the advertised price. Whilst we shall endeavour to minimize any inconvenience, we regret that we cannot accept any liability in this respect.

Force majeure:

Complaints:

Once a villa has been booked and paid for in full, the owner’s details shall be provided and thereafter, guests shall liaise directly with the villa owner upon arrival at the villa. In the unlikely event of a problem with your villa occurring, whilst you are there, you must inform the villa owner so that the matter can be put right. Any claims must be directly addressed to the villa owner.

Changes to bookings:

Although the Company makes every effort to ensure that the advertised descriptions are accurate, it does not own any of the villas and therefore cannot control or prevent any changes. Although changes to villas advertised rarely occur, the Company shall reserve the right to change the description of the villa or service at any time, in which case we shall endeavour to notify you of any changes prior to the commencement of the booking date, if it is practical to do so. No compensation shall be payable by the Company in such cases. No claims shall be accepted for costs or additional expenses incurred as a result of any changes. Wherever possible, any changes made to the booking by you shall be accommodated, although charges may apply.

Sub-letting:

The property may only be sub-let, shared or assigned by you with our consent. Only the persons shown on the booking form are permitted to stay in the property. No pets or animals are permitted unless prior permission is specifically obtained for this.

Binding agreement:

This agreement shall not become binding until we have sent written confirmation of the booking to you.

Jurisdiction:

Signature of the booking form constitutes acceptance of a contract on these terms subject to Cypriot Law and the exclusive jurisdiction of the Cypriot courts.
